"A)" would be the closest connection to your question.

I'll take your word for it that operating a business without a permit is a misdemeanor. A misdemeanor happens to be a criminal act. If a person is killed in the course of some person committing another crime, . . . well Billy, I'll let you look up what that person would be guilty of.
Nothing anybody but you gives a flying fuck about, Scott.
Given the brief nature of the info I gave it could seem as if my assumptions were unwarranted. However, there's a OZ Report Front Page story/link to a News Report about the incident at Jean Dry Lake. That news report (which someone who tries to stay informed has read)...
Do ya ever bother reading...

I strongly disagree with banning the one guy who has the most knowledge about safety issues involving what I believe is the most dangerous part of our sport. I hear someone dies every year from towing. I hope SG bites his tongue in the interest of public safety.
...Kite Strings?
...includes the following information:
RICARDO TORRES, LAS VEGAS REVIEW-JOURNAL:

. . . Special recreation permits are required for commercial use on federal land, according to the BLM.

"This company did not have one," BLM spokeswoman Kirsten Cannon said Tuesday.

Applicants for permits must supply operation plans and maps, Cannon said. If the land falls in more than one federal jurisdiction, applicants must apply to multiple agencies.

Depending on the activity, applicants are required to meet with a BLM outdoor planner, Cannon said. Some permits also require licensing or insurance.

Las Vegas Hang Gliding was not licensed in Las Vegas or Clark County, records show.

Harrison's company was registered as a Nevada limited liability company LLC in January, according to secretary of state's office. . .
So, it seems clear that a "simple" permit MAY have been all that was necessary. But it is also quite or very likely that A LOT more requirements needed to be met. Could be that J K Harrison would not have been able to meet those requirements. Or maybe he would have been delayed in starting his tow for pay business 1, 2, 3 weeks or even a month or two.

Also, Billy, have you ever heard of the "Butterfly Effect"? If not you can look that up too. What it means, quickly, is that a small change in events can cause BIG differences somewhere else. Example - If J K Harrison had been delayed a month in getting his paperwork/insurance/licensing and meeting with the BLM outdoor planner taken care of (in a responsible manner) then an 11 year old boy - and Harrison himself - would very likely be alive today. And it could also be that nothing would have changed. We'll never know because we can't go back and "fix" the past.
Total fucking lunacy. If Michelle - Arys' mom - had gotten drunk enough at lunch to be attracting the attention of the cops on the drive down to Jean there's no fuckin' way her kid would've been scratched. POSSIBLY somebody else's kid but not bloody likely. It takes hundreds of thousands of cycles before things line up right enough for one of these to happen and if you could hop on the TARDIS and just jiggle preceding events a tiny bit you wouldn't have the requisite Perfect Storm.

Something went wrong with the driver and/or the immediate environment that caused him to believe that the glider was off tow and respond as he did. Advance or delay the start ten seconds and it probably wouldn't happen.

If Zack Marzec hadn't hit that monster thermal in a window that may have been less than ten seconds wide we'd still be listening to Jim Keen-Intellect Rooney telling all us muppets how well he had things sussed out and what clueless assholes we all are. But he hit it JUST RIGHT so no more imaginary clothes on that emperor.

But for every instance you jiggle things and prevent a double fatal statistically there will a corresponding instance in which your jiggling sets up a double fatal. And if you weren't stark raving mad that would be fuckin' obvious to you.
But my posts are not about going back in time and fixing things.
Could've fooled me.
They are about learning from the past with the idea of keeping a few more people alive.
Bullshit. If you were capable of learning from the past you'd have learned it already.
Billy, I'm SURE you have no problems with that idea. But let us know if you do.
So Please stop ; I am NOT stupid . . .
I think the biggest problems in the world involve ignorance. Since most people can learn, then they can also stop being ignorant.
If people in hang gliding were simply ignorant then how you explain a couple of decades worth of the standard aerotow weak link?
When that happens things improve and sometimes lives are even saved. Billy, I give you enough credit to think you want to learn how to make things better - and to promote the saving of lives. You've even told your personal story so that other pilots might not make the same mistake(s). I know you want to make things better and a bit safer if possible. Good Job in what you've done so far! In a way, I am following in your foot steps. Okay?
Oh good. A breakthrough conversation between Scott C. Wise and Bille Floyd.
Scott C. Wise - 2015/04/18 20:21:35 UTC

Martin,

Take a look at my above post - it may make some things clearer to you. I'm not on any "high horse". I've been just where J K Harrison was, even if the situations were a bit different. I speak from experience - on the SAME level as Harrison was looking out from.

As to -
Do you really think it is truly relevant to the loss of life? . . .
It was the first miss-step down a path that led to two people dieing. Should we turn a blind eye to that First mistake? Then maybe the second mistake, and maybe the 3rd . . . ? You should read my post above.

As to many if not most of your other comments - I AGREE. Many things combined to cause these two fatalities. The video taken during the flight would be a VERY important bit of information for learning what went wrong aerodynamically - or in relation to the tow mechanics, if they were at fault.
What do you think the "tow mechanics" were, Scott? It was reported across the board without contradiction that the glider wasn't RELEASED from the "tether" - and we have photographic PROOF:

KSNV-CNN-1-1916
http://c2.staticflickr.com/6/5788/23461251751_e98b9c7500_o.png
Image

on top of that. So... Think there's any possibility the RELEASE might have been an issue? Just kidding.
A human factor may also be revealed in the video tape.

But that tape has been seen by the police and I'm sure by the USHPA "investigators" who've gotten involved. But I would bet $ a certain way regarding whether we will ever see that recording. No see, No Learn.
No need to see. We know the glider needed to be released and couldn't be. Industry Standard.
But as far as the USHPA legal team is concerned - No See, No Get Sued.

Finally -

About signing my name. I believe in the right to privacy. My personal identity is not up for public view on the internet. But, I'll tell you what! If you PM me your social security number and credit card number (with security code) I'll PM you back with a little of MY personal info. Deal? (don't take it!)

Here's an alternative - Imagine that I am not a human person but a Corporate person. Imagine that posts presented by "spec_out_hi" are the result of one or more committee meetings. I hope that helps quell your curiosity.

Tandem crash in LV (speculation thread)
Mark G. Forbes - 2015/03/30 23:29:59 UTC

Hi folks,

I understand the interest in learning the cause of this, but could we please not speculate on the forum? We have a very experienced tow administrator (Mitch Shipley) headed to Las Vegas to do an accident investigation, and when we learn what really happened we'll convey that information to our members. He'll be working with two of the local instructors there to get to the truth.

Meanwhile, please refrain from offering speculation or opinion on what might have happened, what might have been theoretically done to prevent it and so on. Emotions are raw, people are hurting, and uninformed speculation doesn't help anybody. News reports are of little use since they're written by people who have no idea how our sport works or what is typical.

Thanks for your understanding and patience.

12-year-old killed in hang glider accident

KTNV Channel 13 Las Vegas - 2015/03/27

Tragedy is unfolding tonight after a day out hang gliding suddenly takes a deadly turn.
Two people are dead tonight - one of them a twelve year old boy.
Metro says that an equipment malfunction may be to blame. Action News reporter Bryan Callahan is live right now with the latest for us. Bryan.

Yeah, Metro says that it was the "TETHER" between the glider and the truck pulling it that caused this crash. Family members who weren't there at the time of the crash say this part of the family loved adventure, and that was one of the reasons they were out at the dry lakebed today.

really, really weird. usualy the realease systems used for hang gliding towing are fail safe and there are weak links that break in such situations. i would really like to know what caused this disaster..
Beats me, dude. Very very reliable industry standard release within easy reach, Infallible Weak Link for which we have an expectation of breaking as early as possible in lockout situations while being strong and reliable enough to avoid frequent breaks from turbulence... Total mystery what could've possibly gone wrong. Maybe the PIC experienced some kind of medical event - but that's just speculation. We'll probably never know what really happened on that tow. I just buried my friend and you want me to have a nice little discussion about pure speculation about his accident so that some dude that's got a pet project wants to push his theories?

Deltaman loves his mouth release.
BFD

I get tired as hell "refuting" all these mouth release and "strong link" arguments. Dig through the forums if you want that. I've been doing it for years but unfortunately the peddlers are religious in their beliefs so they find justification any way they can to "prove" their stuff. This is known as "Confirmation Bias"... seeking data to support your theory... it's back-asswards. Guess what? The shit doesn't work. If it did, we'd be using it everywhere. But it doesn't stand the test of reality.
...how come we're not using it everywhere? How come Jim Keen-Intellect Rooney - the world's foremost expert on everything - isn't using it? How come Bobby Bailey - who's a fucking genius when it comes to the shit - didn't even develop it?

- Great Jeff. Ridgerodent asks Davis a question about load capacity and you answer him with a link to a piece o' crap "designed" ONLY to handle stuff in the zero to light range.

- So we shouldn't WORRY about performance under load?

I have a tandem rating!!!
Lauren Tjaden - 2008/03/23 22:20:15 UTC

When Jim got me locked out to the right, I couldn't keep the pitch of the glider with one hand for more than a second (the pressure was a zillion pounds, more or less), but the F'ing release slid around when I tried to hit it. The barrel release wouldn't work because we had too much pressure on it.

Anyhow, the tandem can indeed perform big wingovers, as I demonstrated when I finally got separated from the tug.
What if that off the scale stupid bitch had been driving for Arys Moorhead's ride a month ago tomorrow?

Donchya think that now would be a good time to start looking at lotsa different issues regarding detaching tether ropes from hang gliders?

- If we shouldn't worry about this then how come the u$hPa - which is all about the safety of the people of varying ages who fly these things and nothing else - said again five months ago:
The United States Hang Gliding and Paragliding Association, Inc. - 2014/10/22
Standard Operating Procedure
12. Rating System
10. Towing Administration
04. Aerotow Pilot Appointment (ATP)

06. A release must be placed at the glider end of the tow line within easy reach of the pilot. This release shall be operational with zero tow line force up to twice the rated breaking strength of the weak link.
Davis Dead-On Straub, who's been at an around all this plenty long enough to understand what's what and who's who, has decided he's now much happier with a 200 pound weak link than he was with the 130 pound weak link that used to bring him to a state of orgasm. So just how well do these bent pin pieces of shit these fucking assholes all market do at four hundred? Fuck that. How well do they do at just half the mandated load?

Jim Rooney - 2010/12/16 18:47:05 UTC

Oh, I've heard the "everything we do is an experiment" line before.
The trouble is, it's not.

I've seen experimentation with towing gear more than anything else in HG.
I've not seen many go out and try to build their own sails for example. When someone does, they're very quickly "shown the light" by the community. Example... the guy that was building the PVC glider in California somewhere.
But for some reason, towing gear is exempt from this.

The difference is what we do has been done by thousands of people already. It's been tested... a lot.
What we do is free of the experimentation part.
It's still dangerous, but not at the level of building new gear is. Not even close.

That's what people fail to realize.
It's no small difference. It's a huge chasm.

Notice how I'm not saying to not do it.
Go forth and experiment. That's great... that's how we improve things.
I'm just warning you of that chasm.

A few years ago, I started refusing to tow people with home made gear.
I like the idea of improving gear, but the lack of appreciation for the world they were stepping into didn't sit with me.
For example... flying with the new gear in mid day conditions?
Are you kidding me????

Approach it for what it is... completely untested and very experimental gear which will likely fail in new and unforseen ways as it tries it's damndest to kill you... and then we can talk.
These flight parks aren't gonna let you risk your lives on completely untested and very experimental homemade gear which will likely fail in new and unforeseen ways as it tries it's damnedest to kill you.

And we sure as hell know this Rube Goldberg piece o' crap:

doesn't work 'cause we're not all using everywhere. This is in LITHUANIA - wherever the fuck that is - ferchrisake. It's not used at ANY of the flight parks and not one single flight park has ever made anything like that available to ANYONE. How much more proof do we need?

Hey Davis...

If simpler is safer then how come your T2C has two pairs of sprogs, eleven pairs of upper surface battens, one pair of transverse battens, one pair of tip wands, and I don't know how many pairs of undersurface battens and internal ribs? Shouldn’t you consider eliminating some of that crap if you're expecting to continue your flying career for much longer?

Why don't you show us the data you have to support your "simpler is safer" bullshit? Seeing as how u$hPa has shredded every "accident" report it's gotten its hands on for the past dozen years and all the flight parks have shredded everything possible and falsified everything not since the beginning of time I'd be MOST interested in your justifications - asshole.

Pro tow Mini Barrel Release?
Steve Davy - 2015/04/27 06:34:37 UTC

What is the load to actuation ratio of this "used at all the flight parks" release, Davis?
HE JUST TOLD YOU - ASSHOLE. He's never had it not release and that's hundreds of times, it's used at all the flight parks, and simpler is safer. And, on top of that, Jeff told you not to worry about that and to check out the Ollie which works fantastic when you're not being towed - in accordance with Lockout Mountain Flight Park's standard for its state of the art aerotow release which isn't warranted as suitable for towing anything.

You fuckin' DEAF or sumpin'?

And Davis deletes the thread. That's OK, motherfucker, I have the page with the last post saved over here.

P.S. 243 hits at my last look - sometime after 2015/04/27 10:00:41 UTC.

I dunno... Why did he reboot Bob and lock down the "Goodbye Bob K?" thread? I'm guessing to keep making sure the only progress this sport makes is backwards.

Or...

Why does a dog lick his balls?
Because he CAN.
